The Cost of Non-Compliance
Since the introduction of the Fire Safety Order in 2006, a number of organisations have received "Improvement Notices" which has required the upgrade of their existing fire doors which has included not only the upgrade of the fire door itself but also the following:
- combined heat and smoke seals
- self-closing devices
- some with automatic properties
- correct fire door handles and locking mechanisms
Court action has been taken against the "responsible person" for not complying with the "protective and preventative measures", as required by the legislation. This has resulted in large fines, sometimes as much as £250,000. It has also meant the restriction of part of the building or a full closure until this work is carried out, which may have a severe knock on effects for business continuity and income.
At the beginning of 2008, a large UK retail chain was fined £250,000 due to non-compliance with the Fire Safety Order.
There are a number of other current legal cases, which have resulted in heavy fines being levied at the "responsible person", particularly in residential care premises and small guest houses. The Fire Service is actively inspecting sleeping accommodation and has made it a priority in their role to ensure full compliance with the new legislation.
Until recently, individuals were not prosecuted for failings in fire safety provisions. However, the recently-introduced Corporate Manslaughter bill changes this and any subsequent loss of life will be investigated thoroughly. This can result in a criminal conviction for the "responsible or competent person".
A south of England hotel was raised to the ground in fewer than 8-minutes due in part to poor compartmentation, which included the provision of fire doors.
